Terms of Service

These Terms set out the rules for using the Twój Klub application. By creating an account or using the application, you accept them.

The Polish version of these Terms is the binding one. This English version is provided for convenience only; in case of any discrepancy, the Polish version prevails.

Who provides the service

The service is provided by Dzmitry Kavalenka, a sole proprietor registered at ul. Wierzbowa 7/2, 63-004 Gowarzewo, Polish tax identification number (NIP) 7792542587.

The service

Twój Klub is an application for managing a small sports club. It supports keeping track of clients, groups, memberships, and payments.

Club clients have no accounts of their own — they exist in the application only as records entered by the club.

The Free plan has no time limit and covers up to 40 clients and 2 trainer accounts. The Pro plan removes both limits.

Your account and eligibility

You must provide accurate information and be authorised to manage the data of the club whose account you create.

You are responsible for activity under your account and for keeping your credentials confidential. You are also responsible for the actions of people you invite to your club.

Your data and responsibilities

You are responsible for the client data you enter into the application and for having a lawful basis to process it.

The club remains the controller of its clients’ data; we process it solely on the club’s behalf and according to its instructions.

This includes the obligation to obtain consent from a parent or legal guardian where a minor’s data is concerned.

Plans, trial and payment

The Free plan has no time limit and requires no card details. It is not a trial and does not expire.

The Pro plan costs 99 zł gross per month. That is the total you pay — all applicable taxes are included. We charge in advance for each billing period.

Payments are handled by Stripe. You enter your card details directly on Stripe’s payment page and they never reach our servers.

The Pro trial lasts 30 days and requires card details when it starts. When it ends, the subscription converts automatically to the paid Pro plan and the first charge is taken, unless you cancel before the trial ends.

Cancellation and refunds

You may cancel your subscription at any time in the application settings. You keep access to Pro until the end of the billing period you have paid for.

We do not refund fees for a billing period already started. The trial exists so you can decide whether the application suits you before paying for the first time.

Non-payment does not delete your data. The account returns to the Free plan, and features beyond that plan’s limits stay unavailable until the subscription is paid again.

Consumer right of withdrawal

If you enter into the contract as a consumer — that is, for a purpose not directly related to your business or professional activity — you have the right to withdraw from it within 14 days of concluding it, without giving a reason.

To withdraw, it is enough to send us a statement at kontakt@twojklub.com.

If you ask us to begin providing the service before the withdrawal period expires and the service is then fully performed, the right of withdrawal expires. If the service was performed only in part, you pay for the part performed up to the moment of withdrawal.

The right of withdrawal does not apply to businesses, including sole proprietors purchasing the service for the purposes of that business.

Price changes

We may change the subscription price. We will give notice in advance, and the new price applies from the next billing period. We do not change the price during a period already paid for.

If you do not accept the new price, you may cancel your subscription before it takes effect.

Acceptable use

Do not use the application unlawfully, do not attempt to access data belonging to other clubs, do not circumvent plan limits, and do not disrupt the service.

Do not enter data into the application that you have no lawful basis to process.

Availability and support

The service is provided on an "as is" and "as available" basis. We do not guarantee a specific level of availability or response time.

We may carry out maintenance that makes the application temporarily unavailable.

Suspension and termination

We may suspend or close an account for non-payment, breach of these Terms, or use of the application that threatens its operation or other clubs’ data. We will give you notice where doing so does not prevent the breach from being addressed.

You may close your account at any time in the application settings.

Before data is permanently deleted, we provide the means to export it. After an account is closed we delete its data, except records we are required by law to retain and activity logs, which we keep for security and accountability.

Intellectual property

The application, its code, its appearance, and its name are our property. Using the service transfers no rights in it to you beyond the right to use the application in accordance with these Terms.

The data you enter into the application remains yours. We do not use it for any purpose other than providing the service.

Limitation of liability

Our liability towards businesses is limited to the fees you paid in the 12 months preceding the event giving rise to the loss.

We are not liable for lost profits or for indirect loss.

These limitations do not apply to damage caused intentionally, to gross negligence, to personal injury, or to liability that cannot be excluded by law — in particular liability towards consumers.

Changes to these Terms

We may change these Terms. We will announce material changes in advance in the application or by email, and the date of the last change is shown at the top of the page.

If you do not accept the changes, you may cancel your subscription and close your account before they take effect.

Governing law and jurisdiction

These Terms are governed by Polish law.

Disputes with businesses are settled by the court with jurisdiction over our registered seat. This does not limit consumer rights arising from mandatory provisions of law, including the ability to bring claims before the court with jurisdiction over the consumer’s place of residence.

Binding version

The Polish version of these Terms is binding. The English version is provided for information only; in case of any discrepancy between the versions, the Polish version prevails.
